Ottawa Hills Challenges Levy Rejection Over Typo

On August 28, 2023, on behalf of Ottawa Hills Local School District, Bricker Graydon filed a Complaint in mandamus with the Ohio Supreme Court. The Complaint requests the Court to order the Lucas County Board of Elections to place the Ottawa Hills current expense levy on the November 7, 2023 ballot. Ottawa Hills followed all procedural steps to place the levy on the ballot and filed its election proceedings 20 days in advance of the August 9th filing deadline. After the deadline passed, the Board of Elections reviewed the election proceedings and rejected them due to a typographical error. Ottawa Hills substantially complied with all relevant statutory requirements. The Court handles election cases on an expedited basis, so it is hoped a decision will be rendered quickly.
