Supreme Court Reinstitutes CMS COVID-19 Vaccine Mandate: UPDATE

This update replaces the Phase 1 and Phase 2 implementation dates in our previous blog post written January 13th for those states* identified in the January 14, 2022 CMS memorandum.

The Centers for Medicare & Medicaid Services issued a memorandum on Friday January 14th implementing extended timelines for the CMS Vaccine Mandate.

Covered employers now have until February 14, 2022 to achieve compliance with the Phase 1 directives listed above and until March 15, 2022 to achieve compliance with the Phase 2 directives listed above. The requirements listed in Phase 1 and Phase 2 remain the same.

*Alabama, Alaska, Arizona, Arkansas, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Utah, West Virginia and Wyoming.
